Welcome to Functional Capacity Experts (FCE). By scheduling an appointment, using our services, or accessing our website, you agree to be bound by these Terms & Conditions. Please read them carefully.

1. Services Provided

Professional Assessment Services

Functional Capacity Experts provides comprehensive functional capacity evaluations, expert witness services, workplace health assessments, and related occupational health services throughout the Ark-La-Tex region (Arkansas, Louisiana, and Texas).

Our services include, but are not limited to:

  • Functional capacity evaluations (FCE)

  • Independent medical evaluations (IME)

  • Expert witness testimony and consultation

  • Pre-employment health screening

  • Ergonomic assessments

  • Disability determination support

  • Work conditioning program consulting

 

Service Variations

The scope, duration, and pricing of services may vary based on:

  • Type of evaluation (workers' compensation, personal injury, Social Security disability, vocational rehabilitation)

  • Volume of medical records requiring review

  • Complexity of the case

  • Referring party requirements

  • State fee schedules (for workers' compensation cases)

2. Scheduling & Appointments

Appointment Scheduling

  • Appointments are scheduled through direct contact with our office or through authorized referring parties

  • All appointments require advance scheduling

  • Evaluation dates are subject to availability

  • Most comprehensive FCEs require 2-day evaluation periods

 

Appointment Confirmation

  • All appointments must be confirmed in advance

  • Patients will receive written confirmation with appointment details

  • Instructions for preparation will be provided prior to evaluation

 

Cancellation Policy

  • 48-Hour Notice Required: Cancellations or rescheduling requests must be made at least 48 hours in advance

  • Late Cancellations: Cancellations made less than 48 hours before the scheduled appointment may be subject to cancellation fees

  • No-Show Policy: Failure to appear for a scheduled appointment without prior notice may result in full evaluation fees being charged

  • Emergency Exceptions: We understand emergencies occur; contact us immediately to discuss your situation

 

Rescheduling

  • Appointments may be rescheduled subject to availability

  • Multiple rescheduling requests may require re-evaluation of case priority

  • Rush requests and expedited scheduling may incur additional fees

3. Payment Terms & Conditions

Fee Schedules

Workers' Compensation Cases: Fees are established according to Louisiana state medical fee schedules and are non-negotiable.

 

Personal Injury Cases: Fees are based on:

  • Standard evaluation procedures

  • Volume of medical records reviewed

  • Report preparation time

  • Expert witness consultation and testimony (if required)

 

Social Security Disability & Vocational Rehabilitation: Streamlined single-day evaluations with specialized pricing structures.

Expert Witness Services: Billed separately based on time, preparation, and testimony requirements.

Payment Responsibility

  • Insurance Cases: Payment is the responsibility of the referring party or insurance carrier unless otherwise arranged

  • Attorney-Referred Cases: Payment terms are established in advance with the referring attorney's office

  • Self-Pay Patients: Payment arrangements must be made prior to evaluation

  • Outstanding Balances: Services may be suspended for accounts with outstanding balances over 90 days

 

Billing & Invoicing

  • Invoices are issued upon completion of evaluation reports

  • Payment terms are typically net 30 days unless otherwise agreed

  • Late payment fees may apply to accounts over 60 days past due

  • Fee schedules are provided to new referral sources upon request

 

Insurance & Third-Party Billing

  • We work with most insurance carriers and workers' compensation systems

  • Pre-authorization may be required for some services

  • Patients are responsible for understanding their insurance coverage

  • We do not bill Medicare or Medicaid directly for FCE services

4. Patient Responsibilities

Medical Information

Patients must provide:

  • Complete and accurate medical history

  • All relevant medical records when requested

  • Current medication lists

  • Information about previous injuries or conditions

  • Worker's compensation or legal case information when applicable

 

Physical Participation

  • Patients must give maximum effort during functional testing

  • Patients should inform evaluators of pain, discomfort, or concerns during testing

  • Patients may discontinue testing at any time for safety concerns

  • Failure to provide adequate effort may be documented in reports

 

Preparation Requirements

  • Arrive on time for all scheduled appointments

  • Bring required documentation and identification

  • Wear appropriate clothing for physical testing

  • Follow pre-evaluation instructions provided

  • Bring any prescribed assistive devices or medications

 

Behavior Standards

  • Treat all staff with respect and courtesy

  • Follow facility safety protocols

  • Comply with evaluation procedures and instructions

  • Maintain appropriate conduct during all appointments

5. Professional & Legal Services

Expert Witness Services

  • Expert witness fees are separate from evaluation fees

  • Deposition and testimony rates are provided in advance

  • Cancellation fees apply for depositions cancelled within 48 hours

  • Travel expenses may be billed separately for out-of-area testimony

  • Preparation time is billed according to established rates

 

Report Delivery

  • Evaluation reports are typically completed within 7-14 business days

  • Rush reports may be available for additional fees

  • Reports are delivered to authorized referring parties only

  • Additional copies of reports may incur fees

  • Reports remain the property of FCE but are provided to authorized parties

 

Confidentiality

  • All services are provided in strict accordance with HIPAA regulations

  • Information is released only to authorized parties

  • Patients must provide written authorization for information disclosure

  • Court orders and subpoenas will be honored as required by law

6. Liability & Limitations

Scope of Services

  • Our evaluations provide objective functional assessment data

  • We do not provide treatment, ongoing care, or medical management

  • Our assessments inform decision-making but do not guarantee specific outcomes

  • Legal and employment decisions remain the responsibility of appropriate parties

 

Limitation of Liability

Functional Capacity Experts is not liable for:

  • Decisions made by employers, attorneys, insurance companies, or other parties based on our reports

  • Legal outcomes in cases where we provide expert testimony

  • Delays caused by third-party provision of records or information

  • Consequences of patient non-compliance with evaluation procedures

 

No Guarantees

We do not guarantee:

  • Specific evaluation outcomes or findings

  • Approval of disability claims or workers' compensation benefits

  • Return-to-work clearances

  • Favorable legal case outcomes

Physical Risk Acknowledgment

  • Functional capacity evaluations involve physical testing and exertion

  • Patients acknowledge inherent risks associated with physical assessment

  • All testing is conducted by qualified professionals using standardized safety protocols

  • Patients may discontinue testing at any time

7.  Intellectual Property & Reports

Report Ownership

  • Evaluation reports and findings remain the intellectual property of FCE

  • Reports are provided to authorized referring parties under license for intended use

  • Unauthorized reproduction or distribution of reports is prohibited

  • Expert opinions and methodologies are proprietary to FCE

 

Use of Information

  • Reports may only be used for the intended purpose for which they were commissioned

  • Use of our reports in unrelated legal proceedings requires separate authorization

  • Media use or publication of our work requires written permission

8. Website Use & Online Services

Acceptable Use

Users of our website agree to:

  • Provide accurate information in all communications

  • Not attempt to breach security or access unauthorized areas

  • Not use automated systems to access our website

  • Not transmit malicious code or harmful content

 

Online Scheduling & Communications

  • Information submitted through our website is subject to our Privacy Policy

  • Online scheduling requests are not confirmed until verified by our staff

  • Electronic communications are not monitored 24/7; emergencies should be handled by phone

9. Modifications to Terms

Right to Modify

  • FCE reserves the right to modify these Terms & Conditions at any time

  • Continued use of our services after changes constitutes acceptance

  • Material changes affecting scheduled services will be communicated directly

 

Service Changes

We reserve the right to:

  • Modify service offerings and procedures

  • Update pricing structures with advance notice

  • Change operational policies and procedures

  • Discontinue services or refuse service in appropriate circumstances

10. Dispute Resolution

Governing Law

These Terms & Conditions are governed by the laws of the State of Louisiana, without regard to conflict of law principles.

Dispute Resolution Process

In the event of disputes:

  1. Contact our office directly to attempt resolution

  2. Disputes that cannot be resolved directly may proceed to mediation

  3. Venue for any legal proceedings shall be Bossier Parish, Louisiana

 

Severability

If any provision of these Terms & Conditions is found to be unenforceable, the remaining provisions shall remain in full force and effect.
